PRIVACY POLICY

This Privacy Policy explains how anitya collects, uses, shares, and protects your personal data when you use the anitya website and Services.

The data controller is Anitya, Unipessoal Lda, a company incorporated under the laws of Portugal, NIPC 518922111, with registered seat at Rua Nova do Almada n.o 81, Piso 3, Sala 2, 1200-288 Lisboa, Portugal ("anitya", "we", "us"). Hosting and certain processing are carried out by our affiliate Anitya.space Metaverso Ltda, a company incorporated under the laws of Brazil, CNPJ 50.208.802/0001-60 (acting as processor) and by third-party infrastructure providers (Amazon Web Services and Google Cloud). We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and the Brazilian Lei Geral de Protecao de Dados (LGPD).

1. Data we collect

  • Identification data: name, email, and any profile details you provide.
  • Account data: username, password (hashed), avatar, and preferences.
  • Content and usage data: the Worlds, prompts, assets you create, plays, remixes, and interactions with the Feed, and credit balances and consumption.
  • Browsing data: cookies, device and connection information, and analytics events.
  • Commercial data: billing details and transaction history.

We do not seek to collect special-category or sensitive data.

2. Legal bases (GDPR) and purposes

We process personal data to: (a) provide the Services and perform our contract with you; (b) operate, secure, recommend, and improve the Services and the Feed (legitimate interests); (c) process payments and comply with legal and tax obligations; and (d) send communications where you have consented. Under the LGPD we rely on the corresponding legal bases, including execution of contract, legitimate interest, compliance with legal obligation, and consent.

3. Cookies

We use cookies to keep you signed in, remember preferences, and measure usage (including analytics). You can control cookies through your browser settings.

4. Storage, hosting, and international transfers

Data is stored in the cloud on Amazon Web Services and Google Cloud. Because hosting and operations involve our Portuguese and Brazilian entities and global infrastructure, your data may be transferred between the European Union, Brazil, and other countries. Where personal data leaves the EEA, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses. We retain personal data for as long as needed for the purposes described and for any additional period required by law.

5. Sharing

We do not sell your personal data. We share it only with: (a) our affiliates (including Anitya.space Metaverso Ltda) for the purposes described; (b) processors and infrastructure providers acting on our instructions; (c) authorities where required by law or valid legal process; and (d) parties to a corporate transaction under confidentiality, or others with your consent.

6. Your rights

Under the GDPR (for users in the EU/EEA) you have the right to access, rectification, erasure, restriction, data portability, objection, and to withdraw consent at any time. You may lodge a complaint with the Portuguese supervisory authority, the Comissao Nacional de Proteccao de Dados (CNPD).

Under the LGPD (for users in Brazil) you have the rights of confirmation and access, correction, anonymisation or deletion, portability, information about sharing, and revocation of consent. You may contact the Autoridade Nacional de Proteccao de Dados (ANPD).

7. Security

We apply appropriate technical and organisational measures to protect personal data. You are responsible for keeping your credentials confidential. If a data breach affecting you occurs, we will notify you and the competent authorities as required by law.

8. Children

The Services are not directed to children below the age required for valid consent in their jurisdiction. We do not knowingly collect their data without the consent required by law.

9. Changes

We may update this Policy. We will give prominent notice of material changes.
