TERMS OF USE

anitya is a platform that lets anyone build, publish, play, and discover interactive 3D worlds. These Terms of Use govern your access to and use of the anitya website, feed, builder, and related services (the "Services").

The Services are provided to you by Anitya, Unipessoal Lda, a company incorporated under the laws of Portugal, NIPC 518922111, with registered seat at Rua Nova do Almada n.o 81, Piso 3, Sala 2, 1200-288 Lisboa, Portugal ("anitya", "we", "us"), which is the party you contract with and pay. Hosting and certain technical operations are performed by our affiliate Anitya.space Metaverso Ltda, a company incorporated under the laws of Brazil, CNPJ 50.208.802/0001-60 and by third-party infrastructure providers (including Amazon Web Services and Google Cloud). By accessing or using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

1.1. anitya provides tools to create 3D worlds (manually or with AI assistance), to publish and play them, and a feed that ranks and recommends worlds for discovery.

1.2. Building worlds manually and publishing and playing on the Services is free, subject to fair-use and the limits described in our pricing. Generating content with AI consumes credits as described in Section 6.

2. Definitions

  • User: any person who registers for and uses the Services.
  • World: any interactive 3D experience created, published, or played on the Services.
  • Content: anything you create, upload, publish, or share, including Worlds, assets, prompts, and text.
  • Credits: prepaid units of usage that you spend when you use AI generation features.
  • Feed: the discovery surface that ranks and recommends Worlds.

3. Your content and the licenses you grant

3.1. You keep whatever rights you hold in the Content you create. anitya does not claim ownership of your Content.

3.2. Operating license. To run the Services you grant anitya a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, publish, display, distribute, and promote your published Content as needed to operate, secure, recommend, and improve the Services and the Feed, and to showcase the Services.

3.3. Remix license between users. Worlds may be remixed and built upon by other Users. By publishing a World you allow other Users to view, play, and, where you enable it, remix and create derivative Worlds, subject to attribution tracking on the Services. You grant other Users the limited license needed for that remix functionality on the Services.

3.4. Attribution. The Services record the lineage of Worlds, remixes, assets, and plays so that contribution and discovery can be tracked and, where applicable, value routed to contributors. This attribution is an operational feature of the Services and is not a determination of legal authorship or copyright.

3.5. anitya's own brand, software, and materials are owned by anitya or its licensors and may not be copied or reused except as permitted by these Terms or applicable law.

4. AI-generated content

4.1. AI generation features produce output based on your prompts. The legal status of rights in AI-generated output varies by jurisdiction and may be limited. anitya makes no representation or warranty that AI-generated output is protectable by copyright or free of third-party rights, and you are responsible for how you use it.

5. Your responsibilities

You agree not to use the Services for any unlawful purpose; not to upload Content that is illegal, infringing, harmful, harassing, discriminatory, or that violates the rights or privacy of others; not to upload malware; not to misrepresent your identity; not to scrape, disrupt, or circumvent the Services; and to keep your account credentials secure. You are responsible for all Content and activity under your account.

6. Credits, payments, and taxes

6.1. AI generation features consume Credits. You may buy Credit packs or earn Credits through participation, as described on our pricing page. Credits are a prepaid right to use the Services and have no cash value outside the Services.

6.2. Payments are processed by anitya (Anitya, Unipessoal Lda). Prices may include applicable taxes (including EU VAT) depending on your location. Credits are non-refundable except where a refund is required by applicable mandatory consumer law.

6.3. We may change pricing and credit mechanics prospectively, with notice where required.

7. The Feed and recommendations

The Feed ranks and recommends Worlds using signals such as engagement, recency, and remix activity. We may adjust ranking and remove or down-rank Content at our discretion, including to comply with law or these Terms.

8. Privacy and cookies

Your use of the Services is subject to our Privacy Policy, which explains how we process personal data under the EU GDPR and the Brazilian LGPD, and our use of cookies.

9. Suspension and termination

We may suspend or terminate accounts that breach these Terms or threaten the security or integrity of the Services or other Users. You may stop using the Services at any time.

10. Disclaimers and limitation of liability

10.1. The Services are provided "as is" and "as available". To the fullest extent permitted by applicable law, anitya disclaims implied warranties.

10.2. To the fullest extent permitted by applicable law, anitya, its affiliates, and its licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights.

11. Self-hosting

11.1. Self-hosting is an optional paid add-on that lets eligible paid members run a designated anitya runtime (the "Self-Hosted Software") on their own infrastructure. It is governed by a separate self-hosting licence (currently the Business Source License 1.1, the "Self-Hosting Licence") together with these Terms.

11.2. Subject to an active subscription and the Self-Hosting Licence, anitya grants you a non-exclusive, non-transferable, revocable right to deploy and run the Self-Hosted Software for your own use. You may not offer the Self-Hosted Software to third parties as a competing hosted or managed service, remove or alter attribution, notices, or the licensing or telemetry mechanisms, or reverse engineer it except to the extent permitted by mandatory law.

11.3. The Self-Hosted Software validates an active subscription through a licence key and periodic activation checks. If your subscription lapses or the licence is revoked, the Self-Hosted Software may degrade (for example, become read-only) while preserving your data. AI generation, the Feed, and the attribution graph remain anitya cloud services, operated and billed by anitya, regardless of where worlds are hosted.

11.4. You must retain all third-party notices supplied with the Self-Hosted Software, including the notices for Godot and other open-source components.

12. Governing law and jurisdiction

12.1. These Terms are governed by the laws of Portugal. Disputes are subject to the courts of Lisbon, Portugal, without prejudice to any mandatory consumer-protection rights you may have in your country of residence (for consumers resident in the European Union or in Brazil).

12.2. If any provision is held unenforceable, the remaining provisions remain in effect.
